Consumer Purchase Terms and Conditions
Pedal Electric LLC
Effective Date: January 1, 2026
These Consumer Purchase Terms and Conditions (the “Terms”) are a legal agreement between You (“You” or “Customer”) and Pedal Electric LLC (“Pedal Electric”, “we”, “us”, or “our”). These Terms apply to all purchases of electric bikes (“ebikes”), accessories, and related products (collectively, the “Products”) within the United States.
By purchasing from Pedal Electric, whether online or in-store, You agree to these Terms in full.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make a purchase.
2. Orders, Payment & Fraud Prevention
All orders are subject to review, including fraud screening through third-party providers (including but not limited to NoFraud).
Pedal Electric reserves the right to:
- Hold orders for verification (up to 3 business days)
- Require additional identification or confirmation
- Cancel or refuse any order at any time
Failure to complete fraud verification may result in cancellation.
Orders cannot be modified, canceled, or adjusted once they have been processed for shipment.
3. Shipping & Delivery
- In-stock orders typically ship within 3–5 business days after processing
- Fraud review may delay processing by up to 3 business days
- Shipping timelines are estimates, not guarantees
Freight / White-Glove Delivery
Certain Products ship via freight carriers and require:
- Scheduled delivery appointment
- Adult присутствence at time of delivery
- Signature upon receipt
Customers are responsible for being available at the scheduled delivery time.
Missed deliveries may result in:
- Redelivery fees
- Storage fees
- Delays outside of Pedal Electric’s control
4. Delivery Inspection Requirement (CRITICAL)
You are required to inspect your shipment at the time of delivery.
If there is visible damage:
- You must note it on the Bill of Lading (BOL) at delivery
- You must take photos immediately
Failure to document damage at delivery may result in denial of replacement or claim.
All damage claims must be reported within 7 days of delivery.
5. Shipping Liability & Restrictions
Once shipped:
- Pedal Electric is not responsible for carrier delays, loss, or damage not properly documented
- Address changes, rerouting, or delivery preference changes may void eligibility for replacement or refund
Refused Shipments
Refusing a shipment is a violation of these Terms and will result in:
- Return shipping charges
- Applicable restocking fees
- Potential denial of refund eligibility
6. Returns & Cancellations
Returns
- Must be initiated within 7 days of delivery
- Product must be unused, clean, and in original packaging
- Customer is responsible for return shipping
A 20% restocking fee applies.
Non-Returnable Items
- Batteries
- Gift cards
- Sale items
- Open-box items
- Special orders
- Gifted orders
Cancellations
- Orders canceled prior to shipment: 5% cancellation fee
- Orders placed but not shipped: 12% administrative fee may apply
7. Storage & Abandoned Orders
If a Product (including repairs or showroom pickups) is not collected within 3 days of notification:
- A $10 per day storage fee will apply
Failure to retrieve the Product within a reasonable timeframe may result in:
- Additional fees
- Forfeiture of the Product at Pedal Electric’s discretion
8. Warranty Policy
Pedal Electric offers a limited 1-year manufacturer warranty.
This warranty does not cover:
- Wear and tear (tires, tubes, brake pads, etc.)
- Improper assembly or installation
- Damage caused by misuse, accidents, or neglect
- Third-party modifications or components
If a bike is assembled by a third party, any resulting issues may not be considered manufacturer defects.
Replacement parts provided during troubleshooting may not carry warranty coverage.
9. Service & Warranty Process
To initiate a warranty claim:
- A technical support form must be submitted
- Photos, videos, and serial numbers are required
Pedal Electric may:
- Diagnose remotely
- Approve parts replacement
- Coordinate with third-party service providers
Labor is only covered if explicitly approved in writing.
10. Performance Disclaimer
All performance metrics (range, speed, battery life) are estimates and vary based on:
- Rider weight
- Terrain
- Weather
- Riding behavior
11. Product Use & Safety
Operating an ebike involves inherent risks, including serious injury or death.
By using Pedal Electric products, You:
- Accept full responsibility for safe operation
- Agree to follow all applicable laws
- Assume all risks associated with use
12. Fraud, Chargebacks & Account Holds
If a chargeback is filed:
- All support and warranty services may be immediately paused
- Pedal Electric reserves the right to dispute with:
- Order confirmations
- Fraud verification records
- Delivery confirmation and signatures
Accounts associated with fraudulent activity may be restricted or banned.
13. Third-Party Shipping & Export Restrictions
Pedal Electric does not allow:
- Third-party shipping arrangements
- Self-shipping of ebikes or batteries
We do not provide:
- Certificates of conformity
- Export documentation
14. Limitation of Liability
To the fullest extent permitted by law:
- Liability is limited to the purchase price of the Product
- Pedal Electric is not liable for indirect, incidental, or consequential damages
15. Dispute Resolution (Arbitration)
All disputes will be resolved through binding arbitration on an individual basis.
You waive:
- Jury trials
- Class actions
- Court proceedings (where legally permitted)
16. Governing Law
These Terms are governed by the laws of the State of the consumer.
17. Respect & Conduct Policy
We understand issues can be frustrating, but abusive or inappropriate behavior toward staff will not be tolerated.
Pedal Electric reserves the right to:
- Refuse service
- Cancel orders
- Void warranties
- Terminate customer accounts
